The 2019 Election which took place on 23rd of February,2019 which the result was announced in Lokoja instead of Kabba which is the headquarter as entrenched in the 1999 Constitution of Federal Republic of Nigeria as amended may not be the only challenging issue of the team of lawyers as led by Lawyer Dapo Otitoju calling for the cancellation of the Kogi West Senatorial district election result,said the election took place on 23rd of February,2019, the result which INEC issued to the Candidate that contested carried a date that was different from the date the election took place
Lawyer Dapo told the three man tribunal led by Justice A.O Chijioke that the result that was announced in Lokoja on 23rd of February,2019 was done without any legitimate document of INEC that was meant to be used in collation and announcement of result.
According to Barrister Dapo Otitoju the result that was issued by INEC as they are the certified copies of EC8E, which was for declaration of result released was 25th of February,2019 and the official date of election was 23rd of February,2019
He said the result that was released dated 25th of February,2019 was not the product of the election that took place which in their document they claimed the election was on 25th of February,2019 but to the whole world the election was held on the 23rd of February,2019
He said the document shows there was was no election on the 23rd but from their document the election was held on 25th of February,2019 which contravene the Constitutional provision and electoral law which stipulated 23rd of February,2019 as the official date of the Kogi West Senatorial district election
Lawyer Dapo said it was after election that they prepared the result which was falsified
The counsel said the returning officer for Kogi West Senatorial district in person of Professor Abdullahi Emmanuel Bala swear to an oath which according to their document the election was held on 25th of February,2019 from the EC8E which was the declaration of result shows that the returning officer certified wrongly which means he is lying on certification because the Kogi West Senatorial election was held on 23rd of February, 2019 and not 25th of February,2019.
He further stressed on this as he said in Exhibit P100 is not the product of the Kogi West Senatorial election held on the 23rd of February,2019 and cannot stand in the face of a lie that election held on 25th of February,2019 and he also said the election result Sheet is characterized with mutilations which automatically invalidated their document
He further said that from PVC,Dino result was inflated with over 48,000 fictitious figure which shows that there was an over voting.
Lawyer Dapo Otitoju urged the honourable tribunal to dismiss the result for not comforming with the Constitutional provision and electoral law
