Shaba/Wambai Tribunal: Appeal Court Reserves Judgment in Suit Challenging Wambai’s Election

The Court of Appeal on Tuesday reserved judgment in the appeal brought by the People’s Democratic Party (PDP) and its candidate, Hon. Barr. Shaba Ibrahim, seeking to nullify the judgment of an Abuja Tribunal, that produced Hon. Abdulkarim Usman Isah Wambai of the All Progressives Congress (APC) as a member of the House of Representatives for Lokoja/Kotonkarfe Federal constituency of Kogi State.

The three-man panel of the appellate court comprising Justices of the court of Appeal took the decisions of both parties after moves by lead, counsel for Wambai ask the court to terminate the appeal as it’s lacking merit in entirety and, while lead counsel to Shaba told the court to nullify the election.

In the appeal, Shaba had through his counsel, urged the Court of Appeal to nullify the decision of election tribunal on the grounds that there was not proper evaluation.

On his part, the Lead Legal team of Hon. Abdulkarim Usman Isah Wamabai, APC, urged the appellate court to dismissed the appeal and said there was a proper evaluation in the judgment of the lower court and insisted that the appeal lack merit to be entertained.

The Wambai legal Team also asked the Court of Appeal to uphold the lower court decision having the jurisdiction to determine an election matter.

The lead council to INEC submitted that both the decision of February 23rd, 2019 which gave birth to the ruling of 2nd September, 2019 were in order having been made inside the mandatory period allowed by law.

After taking submissions of counsel, the appellate announced that judgment in the matter had been reserved to a date that would be communicated to parties.

Speaking shortly after the court section, the Administrator of Kogi LG Hon. Barr. Muhammed Tanko Musa Osuku described the sitting as another beginning of yet another victory to come their way in no distance time.

Also in attendance was the federal lawmaker, Hon. Abdulkarim Usman Isah Wambai who represent the good people of Lokoja/Kotonkarfe federal constituency. He expressed optimism that the same God who grant him victory in the election period, lower tribunal will do same in the court of appeal.
